CAN YOU GET JAIL TIME FOR A FIRST-OFFENSE DUI?
While it’s possible to get jail time for a first-time offense DUI, it’s relatively uncommon for most of these offenders. Part of the reason for this is that DUIs are technically considered traffic offenses and not criminal charges. Incarceration is not a mandatory penalty for a first drunk driving offense, and most drivers aren’t given jail time until their third offense. The maximum incarceration penalty for a first-offense DUI charge is 30 days imprisonment.
WHAT OTHER PENALTIES CAN I GET?
The penalties you face for a DUI conviction depend on your criminal history and the circumstances of the incident. First-time offenders with a blood alcohol concentration (BAC) of less than 0.10% have the highest chance of reducing or perhaps even dismissing their charges.
